Effective from April 05, 2021,

this User Agreement (the "Agreement") is concluded between AVANTATRADING, LLC, PSRN 1047796849814 (the "Company", "we") and any person ("you") intending to use and/or using the site at https://atopicapp.ru/ on the Internet, the Atopic App (iOS/Android) for mobile devices, and all related services, features, and content offered by the Company (collectively, the "App").

Company - AVANTATRADING, Limited Liability Company, (PSRN 1047796849814, address: 143345, Moscow region, Naro-Fominsk, Sofino, 2).

Application (App) – software and hardware complex Atopic App, consisting of a website at the address https://atopicapp.ru/ on the Internet and the Atopic App for mobile devices.

User – a person who intends to use or uses the Application.

Account – a unique User ID that includes the name (login) and email address required for registration and subsequent use of the Application.

When you create an Account with Atopic App, access or use the App, you acknowledge that you accept all the terms of this Agreement and agree to comply with them.

If you do not fully or partially agree to the terms of this Agreement, you may not use the App.

We reserve the right to make changes to this Agreement. If you continue to use the App after the effective date of the updated version of the Agreement, you confirm that you accept the Agreement with all changes. We recommend that you review the text of this Agreement from time to time to be aware of possible changes.

Please note that the Atopic App is not a medical app.
Application, website on the Internet www.atopicapp.ru and all related services, features, and content offered by the Company are in no way a substitute for medical advice, diagnosis, and treatment.

Please, do not neglect your health and/or the health of your loved ones (your child, relative).

Before making any decisions or taking any actions that may affect the overall well-being or condition of the skin in atopic dermatitis, including based on the data obtained in the app, please, consult a licensed doctor. In any case, do not neglect to consult a specialist, if you have any questions or something bothers you in connection with the diagnosis of "atopic dermatitis".

The Company is not responsible for any errors, technical inaccuracies or typos in the materials provided.

When registering or updating your account in the Atopic App, you will be asked to provide the following personal information: name, email address, gender, city, date of birth, and who has an atopic diagnosis (status "atopic", "atopic parent", "atopic relative", "doctor"). This information will be stored and used strictly in accordance with our Privacy Policy.

By registering an account with Atopic App, you agree to provide the company with accurate and complete information, and to update it as it changes.

The Atopic App is intended for users who have reached the age of majority. If you are under the age of 18, your legal representative (parent or guardian) must review and accept the terms of this Agreement. By using this App, you confirm that your legal representative has read and accepted this Agreement. We reserve the right, at our sole discretion, to restrict access to the functionality of the App to users under the age of 18.

Any data (personal data, photos and information related to health and/or skin condition) that you send through the App is regulated by the Company's Privacy Policy.

If you send a request to an email address info@atopicapp.com, via the feedback form on the website atopicapp.ru or in the App, register on the site atopicapp.ru or in the App, you are solely responsible for the content of the messages you send. By sending a request or registering on the site atopicapp.ru or in the App, you accept the terms and conditions of Privacy Policy and consent to the processing of your personal data.

In case you enter on the site atopicapp.ru or in the App, the data of your minor child, including uploading photos of the child, you consent to the processing of his personal data, similar to that specified above.

By registering an account and using the App, you agree not to use it for any purpose prohibited by this Agreement. You are responsible for all your actions in the App, including uploading any data to the app, and you agree to comply with all local, state, and national laws, regulations, and applicable regulations.

By registering an account and using the App, you agree that you will not violate this Agreement and will not take any of the following actions:

• copy, borrow, modify, translate into other languages or create derivative works of any text and/or graphic materials presented on the site atopicapp.ru, in the Atopic App and related products and marketing materials without the written permission of the Company;

• recycle, reverse engineer, decompile, or disassemble the Application;

• allow others to use the App by providing them with your account information, including reselling, renting, or distributing it by any other means;

• use the App in conjunction with any device, program, or service to circumvent the technical measures used to control access to the App;

• use the Application and / or its components to collect data that can be used to create, refine or improve a competitive product or service;

• use an email address info@atopicapp.com or feedback forms in the App or on the website atopicapp.ru for advertising, sending chain emails, spam, or duplicate messages;

• use your account to commit any illegal actions;

• upload for transmission any messages that contain data about third parties and violate their rights;

• upload to the App, send to the email address info@atopicapp.ru or through the feedback forms on the site atopicapp.ru or in the Application, any materials that may entail civil or criminal liability in accordance with the current legislation of the Russian Federation, including materials containing propaganda of hostility, ill-treatment, discriminatory or disparaging statements based on race or ethnicity, religion, nationality, gender identity or sexual orientation, as well as other grounds for which discrimination is possible, shocking or frightening content, pornography, sexual content, and so on.

• send to an email address info@atopicapp.com through the feedback forms or directly into the Application, any materials, files or programs containing software viruses or any other malicious computer code intended to limit the functionality of the Application, interrupt the operation or destroy any of its components.

Any violation of the terms of this Agreement will result in the blocking of your account and will force us to immediately take the required actions in accordance with this User Agreement, the Privacy Policy of the Company and the current legislation of the Russian Federation.

To avoid misunderstandings and unauthorized use, we must inform you that the Company owns the exclusive right to the software in its entirety (the artificial intelligence recognition model and the iOS and Android applications), as well as all text, graphics, audio and video materials that may be presented in the Application, on the website atopicapp.ru and in any marketing materials distributed on behalf of the Company.

The use of any components of the Application without the written permission of the Company is unacceptable and strictly prohibited for any commercial and non-commercial purposes.

If you would like to use the brand name, logo, trademark, Atopic App character, App recognition model results, domain name, color scheme and/or any identification with distinctive brand characteristics or other content belonging to the Company, please send a written request for permission to the email address info@atopicapp.com.

The main goal of the Atopic App is to help people with a confirmed diagnosis of atopic dermatitis (AtD) to provide competent skin care, follow the doctor's instructions and successfully monitor the condition in AtD.

Please note that the Atopic App is not a medical application and is not intended for the diagnosis or prevention of any diseases.

Any information, including the results of the recognition of the artificial intelligence model, automatic determination of the severity, chatbot tips, etc., presented in the Application is for educational purposes only, does not guarantee the improvement of the health of users diagnosed with "atopic dermatitis", in any case does not replace medical advice and treatment.
We encourage you to take a responsible attitude to your health and the health of the people you care about, and not to neglect consultations with your doctor on improving the well-being and condition of the skin in atopic dermatitis.

Any disputes arising in connection with this Agreement shall be governed by the terms of this Agreement and the applicable laws of the Russian Federation.
Claims related to this Agreement will be considered individually and in writing, sent to the email address info@atopicapp.com

We reserve the right to change, expand and improve the Application without prior notice to the User. If necessary, we may also selectively or completely disable certain features of the App at any time, or completely terminate part or all of the App. The use of the Application does not guarantee the continued provision of use and access to it. Any changes to the functionality of the App will be made at our sole discretion.

This Agreement is valid for the entire period of use of the Application by the User.

We reserve the right to change the terms of this Agreement by publishing a new version in the Application and on the website atopicapp.ru. The current version of the Agreement becomes mandatory for the User from the moment of publication. The User undertakes to regularly review the text of the Agreement published in the Application in order to get acquainted with the changes.
